What is Verbal Harassment in NJ?

Verbal harassment is the use of abusive, offensive, hostile or derogatory language towards a coworker or an employee. These include making offensive jokes, slurs, mockery, bullying, intimidation and insults. Verbal harassment can be a form of sexual harassment. For instance, when an employee makes sexually pervasive comments on another employee or repeated requests for a date. Although verbal harassment does not cause physical damage, it causes emotional damage on the victim and creates a hostile working environment. Employees have a right to protection against verbal harassment in the workplace. So what is considered verbal harassment in NJ and what does it look like? Let’s have a look below. 

New Jersey Law 

In New Jersey, harassment is addressed under the New Jersey Code of Criminal Justice (Title 2C). Verbal harassment can fall under the category of "harassment" if it meets certain criteria. According to N.J.S.A. 2C:33-4, a person is guilty of harassment if, with the purpose to harass, annoy, or alarm another person:

1. They make or cause to be made a communication (including speech, gestures, or written messages) in an offensively coarse manner or any other manner likely to cause annoyance or alarm, or

2. They subject another person to striking, kicking, shoving, or other offensive touching, or threaten to do so, or

3. They engage in any other course of alarming conduct or repeatedly committed acts with the purpose to alarm or seriously annoy such other person.

Penalties for New Jersey Harassment 

It's important to note that intent is a crucial factor when determining whether a communication or conduct qualifies as verbal harassment. The intention to harass, annoy, or alarm the other person is a key element that needs to be established. If someone is found guilty of harassment in New Jersey, it can be classified as a petty disorderly persons offense, which can result in penalties such as fines, probation, or even jail time, depending on the circumstances and severity of the offense.
